Blue Mountain Resorts granted leave to appeal reporting decision

On October 4, Ontario’s Court of Appeal granted Blue Mountain Resorts Ltd. the right to appeal an earlier decision determining that all fatal and critical injuries occurring at a workplace – whether involving a worker or someone else – should be reported to the Ministry of Labour. The appeal involves an Ontario Labour Relations Board (OLRB) decision earlier this year, which determined that all fatal and critical injuries occurring at a workplace, not just those involving workers, should be reported to the Ministry of Labour. The OLRB decision was later upheld by the Ontario Divisional Court

 

In its motion to appeal, Blue Mountain Resorts argued that the OLRB’s broad interpretation of the reporting provision would lead to “an absurd result.” The reporting provision appears in section 51 of the Occupational Health and Safety Act.
